Section 01

Policy Purpose

This Tax & Compliance Addendum defines the responsibilities of participants within the XGlobal Digital Economy Ecosystem™ regarding taxation, reporting obligations, payment requirements, verification procedures, and regulatory compliance.

It is intended to establish a clear framework under which participation-based earnings, commissions, rewards, referrals, and other economic benefits associated with the XGlobal ecosystem may be administered in accordance with applicable laws and regulatory requirements.

Participation in the XGlobal ecosystem does not relieve any participant of independent tax, reporting, licensing, or regulatory obligations applicable to that participant.

Section 02

Participant Tax Responsibility

Each participant is solely responsible for determining, declaring, reporting, and paying any taxes that may arise from their participation in the XGlobal Digital Economy Ecosystem™.

  • All participants are responsible for declaring and paying taxes arising from ecosystem participation, earnings, commissions, rewards, or other applicable income.
  • Participants must comply with applicable local, national, state, provincial, and international tax laws.
  • Tax obligations vary according to the participant's jurisdiction, legal status, residence, business structure, and source of income.
  • Participants are responsible for obtaining independent professional tax advice where appropriate.

Failure to satisfy applicable tax or reporting obligations may result in legal consequences and may also affect eligibility for certain ecosystem payments, rewards, commissions, or participation features where permitted by applicable law.

Section 03

Compliance Documentation

To support payment processing, tax reporting, identity verification, fraud prevention, and regulatory compliance, XGlobal Holdings LLC may require participants to provide appropriate documentation.

  • U.S.-based participants may be required to submit applicable IRS documentation, including forms such as Form W-9 where appropriate.
  • Non-U.S. participants may be required to provide applicable IRS forms, including Form W-8BEN or other appropriate documentation, depending on their circumstances.
  • International participants may be required to provide equivalent tax identification or regulatory documentation under applicable local laws.
  • XGlobal may request documentation necessary to verify identity, residency, tax status, business status, or payment eligibility.
  • XGlobal may issue tax or payment reporting forms where legally required, including applicable U.S. forms such as Form 1099 or Form 1042-S and applicable international equivalents.

Section 04

Global Participation Compliance

XGlobal supports participation from individuals and organizations located in different jurisdictions. Participants remain responsible for ensuring that their participation is lawful within the jurisdiction or jurisdictions that apply to them.

  • Participants outside the United States must comply with applicable local tax laws.
  • Participants must comply with applicable currency, financial reporting, exchange control, and payment regulations.
  • Additional documentation may be requested to satisfy international compliance requirements.
  • Cross-border participation and payments may be subject to tax reporting, withholding, documentation, or other regulatory requirements.
  • Participants are responsible for obtaining professional advice regarding obligations applicable to their circumstances.

Section 05

Payment Controls & Withholding

To maintain payment integrity and comply with applicable legal, tax, regulatory, fraud prevention, and verification requirements, XGlobal Holdings LLC may apply appropriate payment controls.

  • Commissions, rewards, or other payments may be withheld temporarily while required documentation is being obtained or verified.
  • Payments may be delayed where additional compliance verification is reasonably required.
  • Payments may be adjusted where required by applicable law, tax rules, regulatory requirements, or payment processing requirements.
  • Applicable tax withholding may be applied where required by law.
  • Payment access may be restricted where necessary to prevent fraud, unauthorized activity, sanctions violations, or other unlawful activity.

Nothing in this Addendum requires XGlobal to make a payment where doing so would violate applicable law or a binding regulatory requirement.

Legal & Regulatory Compliance

Participants are responsible for ensuring that their use of the XGlobal ecosystem and all related activities comply with applicable laws, regulations, contractual obligations, and industry requirements.

  • Tax laws and reporting requirements

  • Advertising and marketing standards
  • Consumer protection requirements
  • Anti-money laundering requirements
  • Applicable sanctions and restricted-party requirements
  • Identity verification requirements
  • Applicable licensing and registration requirements

XGlobal may implement reasonable compliance controls and procedures designed to protect the integrity of the ecosystem and support compliance with applicable legal and regulatory obligations.

Verification & Audit Rights

XGlobal Holdings LLC reserves the right, subject to applicable law, to review, verify, monitor, and audit participation activity where reasonably necessary to confirm compliance with this Addendum and protect the integrity of the XGlobal Digital Economy Ecosystem™.

  • Participants may be required to provide supporting documentation.
  • Verification may include review of earnings, referrals, commissions, payments, account information, and participation activity.
  • Additional information may be requested where activity appears inconsistent with applicable compliance requirements.
  • Non-compliance may affect participation status, payment processing, rewards eligibility, or access to certain ecosystem features where permitted by applicable law.

Compliance reviews may be conducted internally or with the assistance of qualified third-party service providers, professional advisors, auditors, or other authorized parties.

Ecosystem Updates

XGlobal is a continuously evolving digital economy system. This Addendum may be updated from time to time to reflect changes in applicable laws, tax frameworks, regulatory requirements, payment systems, compliance procedures, or the structure and functionality of the XGlobal ecosystem.

Where appropriate, XGlobal may provide notice of material changes through its websites, dashboards, communications, or other appropriate channels.

Continued participation following the effective date of an updated Addendum constitutes acknowledgement of the updated terms to the extent permitted by applicable law.
